Fund Me Fest Popular Music Grants
Guidelines and Procedures

1.         Eligibility

1.1       “Fund Me Fest Popular Music Grants” (the “Grant”) is a private initiative to support up and coming talent in the music field by creating a networking space between artists, vendors of products/services, while also enabling the transfer of knowledge from different professionals in the music industry to these motivated Artists.

1.2       To be eligible for the Grant, an individual must be a registered member of Fund Me Fest (each, a “Member”), having completed the required membership registration form found at www.fundmefest.com (the “Website”) and paid all necessary registration fees. To be considered for the Grant, a Member must be a Canadian citizen, Canadian permanent residents and/or Aboriginal resident in Canada, aged 16 or older. Members under the age of 18 shall require prior permission of a parent or guardian to be eligible for the Grant.

1.3       Only individual Members will be eligible for a Grant. No applications may be made or will be accepted by bands, groups or other organizations consisting of more than one Member.

1.4       Each eligible Member will not have entered, and shall not enter during participation in the Grant process, into any contractual, commercial, sponsorship or other any other agreements that would prohibit the Member the ability to grant any and all necessary rights to The V Media Productions Inc. (the “Company”) and its affiliates, assignees, or licensees, as required, including but not limited to, the recording and exploitation of the Member’s participation in the Grant, or an ancillary property thereto, and/or any rights to the Member’s name, image or likeness related to marketing, merchandising or sponsorship of the Grant.

2.         Online Application

2.1       Between Monday, February 27, 2017 at 12:00 a.m. EST until Monday, April 17 2017 at 11:59 p.m. EST (the “Online Application Period”), eligible Members may apply for the Grant by submitting:

a)         A fully completed Online Grant Application at www.fundmefest.com;

b)         A brief biography of the Member, including Member’s background, previous performances and professional experience;

c)         One (1) original musical recording, performed and wholly owned by Member (each, a “Musical Work”), uploaded to the Website in MP3 format; and

d)         Provide a detailed answer to the question “What would you do with $20,000?” (the “Question”).

2.2       PLEASE NOTE: Only one (1) Online Grant Application can be submitted per Member.  If more than one (1) submission is made by a Member, those submissions will be immediately disqualified.

2.3       Each Member will receive confirmation, either by phone or email, when the Member’s Online Grant Application is received and deemed eligible for consideration in the Grant.

2.4       The Company reserves the right, at any time, to reject and/or disqualify any Online Grant Application which the Company, in its sole discretion, determines does not satisfy any of the Guidelines and Procedures herein.

2.5       All Online Grant Applications will become the property of Company upon submission and will not be returned to Member, regardless of the success or failure of such application.

3.         Semi-Finalist Selection

3.1       Following the completion of the Online Application Period, all eligible Grant applications will be reviewed and evaluated by a jury.  Between April 17, 2017 through DATE  (the “Selection Period”), all eligible Member applications will be evaluated and judged by the Jury based on the following criteria:
Each piece of criteria is judged out of 10, creating an overall score of 40.

1. Originality: artistic integrity, uniqueness

2. Musicality: performance/delivery, skill, technique, interpretation, energy

3. Song: writing, arrangement, composition, vocals & lyrics

4. Potential for commercial success: relevance, salability, potential audience engagement

Notes:

Artists will be judged solely on artistic merit, without influence of sales history, industry affiliation or genre.

Applications submitted need to be radio friendly (clean). Any submission that do not follow this guideline will be automatically disqualified.

Jurors are required to review all assessment tracks and score the submission based on the Fund Me Fest criteria, and provide objective and constructive feedback.

Jurors must have confidence in their ability to make an objective assessment of a project based on the assessment tracks and materials provided.

 

–          The preselection process is strictly based on objective and clearly outlined criteria as stipulated by Fund Me Fest.
–          Z103.5 is only a promoter/advertiser for the Fund Me Fest and the event leading up to the Fund Me Fest. Z103.5 is NOT a sponsor or a partner/joint venture of Fund Me Fest. Z103.5 is NOT the administrator of the event or Fund Me Fest.

3.2       Following the Preselection Period, Fund Me Fest’s blind Jury shall determine successful applications (each, a “Semi-Finalist”) based on the above criteria. The Company reserves the right, at any time, to select and/or reject any Member as a Semi-Finalist in its sole discretion.

3.3       Each Semi-Finalist will be notified of their selection by the Company on or before DATE  by phone or email.

3.4       Each Semi-Finalist will be invited to attend the Fund Me Fest event to take place at the Queen Elizabeth Theatre in Toronto, Ontario (the “Venue”) on May 5, 2017 (the “Event”), for the opportunity to be selected by the Jury and/or Company to perform the Member’s Musical Work and be selected for a Grant. Any Semi-Finalist that is unable to attend and/or perform at the Event shall be automatically deemed ineligible for a Grant.

3.5                   Semi-Finalists shall be solely responsible for all travel and accommodation costs associated with attendance to the Event.

4.         Fund Me Fest

4.1       Finalists selected to perform their Musical Work will be informed of their selection and set time by the host of the event on May 5, 2017.
4.2       Each Finalist will have ten (10) minutes, excluding set-up and take-down to perform their set in front of a live audience and the Jury, and answer the Question.

4.3       Each Semi-Finalist shall provide his/her own instrumentals for the Event. All sound and lighting equipment will be provided and set-up by Company No pyrotechnic or fire-related products will be allowed on stage or in the Venue.

4.4       Any and all sound system adjustments during Finalist set-up and performances will be made by Company’s official sound technician only.

4.5       No Semi-Finalist will encourage or invite actions by audience members during any Finalist performances that may be deemed unsafe, including but not limited to audience members coming on stage, slam dancing, and/or moshing. Any Semi-Finalist deemed by Company to be encouraging and/or inviting such unsafe actions will be, at Company’s sole discretion, automatically disqualified from consideration for a Grant and removed from the Venue.

4.6       All Semi-Finalists will respect and adhere to any and all requests, instructions and/or directions made by Company, the Venue, and their respective employees, contractors and/or representatives during the Event.  Any Semi-Finalists found in breach of this section will be, at Company’s sole discretion, automatically disqualified from consideration for a Grant and removed from the Venue.

4.7       All Semi-Finalists acknowledge and agree the Event and the Venue shall be filmed for the purpose of a television broadcast (the “Series”) and/or any other use in any and all media throughout the world in perpetuity.  Furthermore, the Semi-Finalists acknowledge and agree that his/her Musical Work and performance thereof shall be recorded for the same purpose and use.

5.         Finalist Selection

5.1       Each selected Finalist will perform their Musical Work and answer the Question in front of the Jury.

5.2       The Jury shall evaluate each Finalist based on the following criteria:

5.3       The Jury shall select, at their sole discretion, the top six (6) Applicants, based on the above criteria, as recipients of the Grant (each, a winner). Five (5) winnerswill each be awarded a Grant valued at One Thousand Canadian Dollars ($1,000). The top Finalist, based on the above criteria, will be awarded a Grant valued at Twenty Thousand Canadian Dollars ($20,000).

5.4       The Winners will be announced following the conclusion of the Event.

5.5       The Winners will be profiled on the Website. Each Winner’s profile will include the audio link of said Winner’s Musical Work submitted as part of the Online Application and performance at the Event.  Furthermore, all winners shall participate, upon reasonable notice, in any and all post-Event publicity, advertising, marketing, sponsorship and/or other post-production activities in relation to the Grant, the Event and/or the Series, at Company’s sole discretion.

6.         General Rules

6.1       Without prior notice to any Member, Company reserves the right to change the structure, schedule or any other aspect of the Grant at any time including, without limitation, adding or deleting Members, applications, performances or any other part of the Grant and/or the Event.  Members’ contribution to the Grant and/or the Event may include additional activities relating to the Grant, the Event and/or the Series including but not limited to various interviews, appearances, promotional, publicity, sponsorship and merchandising activities in any and all media as requested by Company at any time upon reasonable notice.

6.2       Company and the Jury’s decisions on all matters regarding the Grant, the Event, the Series, the Semi-Finalists, and the Finalists are final.

6.3       Company has the right at any time to require additional proof of identity, age and/or eligibility.  Failure to provide such proof within a reasonable time could result in disqualification.  All personal details and information requested by and supplied to Company by each Member must be truthful, accurate and in no way misleading.  Company reserves the right to disqualify any Member from any process in its sole discretion should Member at any stage supply untruthful, inaccurate or misleading personal details and/or information, or should the Member be ineligible to continue in the Grant process.

6.4       Company will have no obligation or liability whatsoever to a Member who is unable to attend or take part in any part of the Grant and/or Event, for whatever reason, or who is removed from the Grant process as determined by Company in its sole discretion.

6.5       Company reserves the right to amend these Rules and Procedures or terminate any aspect of the event or the event itself without any notice or liability to any and all Members.  Company further reserves the right to replace, at its discretion, any Member that for any reason fails, or is disqualified from, or unable to participate in any aspect of the Grant process as determined by Company in its sole discretion, with another replacement Member, notwithstanding that such replacement Member may have been previously eliminated.

6.6       At all times each Member must behave appropriately and respectfully when taking part in the Event, including but not limited to in relation to other Members, and Company and its employees and agents, and observe the Guidelines and Procedures and any other rules or regulations in force at the Venue and/or other locations. Company reserves the right in its absolute discretion to remove from any premises or location any Member who breaks such rules and/or fails to behave appropriately in Company’s discretion and to disqualify such Member.

6.7       All Members understand and agree that Company owns the copyright in the Grant, the Event and the Series, including but not limited to Member’s performances therein, and Company and its licensees and assigns can use, advertise, exploit and distribute, in any media whatsoever, including without limitation, the Internet, now known or hereafter created, worldwide in perpetuity, the Member’s performances and appearances, Members’ comments and Member’s name, likeness, image or voice without any further consent or compensation of any nature or kind.  All Members agree to irrevocably waive any and all copyright interest, of any nature or kind, they may have in their comments, applications, performances and appearances, including without limitation any moral rights in the foregoing.

6.8       Notwithstanding the foregoing, Member’s Musical Work, including all copyright therein, shall at all times remain the sole property of Member and Company shall not have any right, title or interest in and to the Musical Work. Each Member hereby represents and warrants that the Musical Works submitted is wholly original and owned or controlled by that Member, and that any use of the Musical Work in relation to the Grant, Event and/or Series will not infringe or violate the rights of any third party, including but not limited to copyright, trademark, privacy, defamation, libel, and/or slander.

6.9       Members, upon submission of their Online Grant Application, hereby irrevocably grant to Company, the non-exclusive, perpetual, royalty-free, no-cost license and right to use the Online Grant Application and Musical Work submitted as part of the Grant, and all images, videos, performances, artwork, text, graphics, names, likenesses, and biographical information contained therein, in any medium including streaming media, film, television, print, interactive devices, mobile media, Internet and on-line systems, and digital billboards. Company will have the right to use the Online Grant Application and Musical Work submitted as part of the event in any merchandising, advertising, marketing, or promotion. All Members agree that Company shall have the sole discretion in determining the extent and manner of use of Online Grant Application and are not obligated to use any entry.

6.10    By submitting an Online Grant Application, each Member hereby releases, discharges and holds harmless The V Media Productions Inc. and its respective parents, subsidiaries, successors, related and affiliated companies, licensees, assigns, directors, officers, employees, contractors, agents, and sponsors from all liability, claims or damages, including without limitation, for death, property damage,  personal injury, libel, slander, defamation, invasion of privacy and infringement of copyright, or any other cause of action arising out of or in connection with Member’s participation in the Grant, Event and/or Series, including but not limited to the acceptance, possession, use or misuse of any Grant by Member in connection with the Grant, Event and/or Series or resulting from participation in any related activity, if applicable. The V Media Productions Inc. reserves the right to cancel or suspend the Grant, Event and/or Series, and cancel or refuse any entry or any individual being awarded the Grant.

6.11    Company assumes no responsibility for any error, omissions, interruption, deletion, defect or delay in operation with transmission, communications, line failure, theft or destruction or unauthorized access to or allegation of submissions to the Grant. Company is not responsible for any problem or technical malfunction of any telephone network or lines, computer online systems, servers, equipment or software, failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet or at any website, phone lines, or any combination thereof, including any injury or damage to Member’s computer related to or resulting from participation in this event. CAUTION: ANY ATTEMPT BY A MEMBER TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE HONOUR PROGRAM IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, PRODUCER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.

6.12    In the event of any dispute concerning the operation of any element of the Grant or these Guidelines and Procedures, the decision of Company will be final.By applying for a Grant, all Members agree to be bound by these Guidelines and Procedures, which will be posted on the Company website for the duration of the Grant. Members further agree to be bound by the decision of the Jury, which shall be final and binding in all respects.
6.13    Guidelines and Procedures are additional to and do not supersede any and all release forms signed by the Members and in the event of any conflict between any release form and these Guidelines and Procedures, the release form will prevail.

6.14    PRIVACY: By apply for a Grant, each Member agrees to:

6.14.1 Company’s use of Member’s personal information for the purposes of administering and advertising the Grant, Event and/or Series and, unless otherwise specified, for marketing and consumer research purposes; and

6.14.2 To the extent that Company collects, uses and discloses to third parties a Member’s personal information, it will do so only for the purpose of administering the Grant.

6.15    LAWS. These are the official Guidelines and Procedures. This Grant is subject to all applicable Federal and Provincial laws and regulations. The Guidelines and Procedures are subject to change without notice in order to comply with any applicable local, provincial, and federal laws or the policy of any other entity having jurisdiction over Company, and/or its affiliates or sponsors.  Any questions or issues regarding the Guidelines and Procedures or the rights and obligations between Members and Company in respect of the event shall be governed by and construed in accordance with the laws of the Province of Ontario.
